General Covenants and Restrictions

In an effort to help simplify the General Covenants and Restrictions of the Association, we have compiled a listing of the most commonly applied rules. Please note that these are just a summary of the rules and the official Association Rule Book is the final authority. Rule 7 and Rule 8 are clarifications of recent situations by the Board of Directors.

Architectural Change Form

Whenever a homeowner would like to install a fence, deck, shed, pool or add an addition to their home, the Association needs to be informed of the plans so that they can ensure that the new installation conforms to the current Briercliff Homeowners Association Rules and Regulations. The process includes the submission of an Architectural Change form.

Rules Variance Form

Whenever a homeowner would like a temporary variance for a particular rule, the homeowner needs to inform the board and request a variance to the current Briercliff Homeowners Association Rules and Regulations. The process includes the submission of a Rules Variance form.

BRIEF RULES OVERVIEW

WINTER SPECIFIC RULES:

  1. Snow fences are not allowed and portable basketball nets must be stored out of view during the winter months.
  2. Portable basketball nets must be stored in your garage or in your side-yard or back-yard out of view form the street. If you are using them in the winter, they must remain upright.

GENERAL ASSOCIATION RULES:

  1. TRAILERS empty or with boats, jetskiis, campers and all other trailers of any kind are prohibited from being parked in your driveway overnight. You can seek a variance if you have a special request
  2. SIGNAGE on your property is not permitted (i.e. Political, Contractor signs). Realtor signs and small alarm company signs are permitted.
  3. Refuse totes must be stored in a location that keeps them out of the view from your surrounding neighbors and must be brought in by the evening of the pickup-day.
  4. Architectural Approval is required prior to the start of any improvement to your property – i.e. house-addition,  fences, decks, sheds, pools, etc.
  5. PARKING is only permitted on driveways and roadways with adherence to Town Parking Ordinances. Parking on lawns or other non-paved surfaces is not allowed.
  6. Dogs must be walked on leashes (per Town of Hamburg law) and you must pick up after your pet.
  7. Grass clippings, branches, trimmings rubbish and other debris CANNOT be placed on the street or sidewalk for any reason.  Grass clippings can be eliminated with your garbage.  Trimmings and rubbish can be placed out on your boulevard (not hanging into the street) no more than 48 hours before their scheduled removal / pickup by Waste Management or the Town of Hamburg.
